Am preg\u0103tit mai jos c\u00e2teva repere pentru tinerii angaja\u021bi.<\/p>\n\n\n\n<p><strong><span style=\"color:#f05a23\" class=\"has-inline-color\">1<\/span><\/strong>. <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Ce \u00eenseamn\u0103 s\u0103 fii angajat full-time (norm\u0103 \u00eentreag\u0103) \u0219i ce \u00eenseamn\u0103 part-time (norm\u0103 par\u021bial\u0103) din perspectiva drepturilor tale ca salariat?<\/span><\/strong><\/p>\n\n\n\n<p>Diferen\u021ba dintre cele dou\u0103 \u021bine de timpul de lucru: \u00een timp ce norm\u0103 \u00eentreag\u0103 ar presupune s\u0103 lucrezi opt ore pe zi, cinci zile pe s\u0103pt\u0103m\u00e2n\u0103, norma par\u021bial\u0103 \u00eenseamn\u0103 mai pu\u021bin de at\u00e2t. Dar drepturile salaria\u021bilor part-time trebuie s\u0103 fie acelea\u0219i cu ale celor full-time. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201ePentru salaria\u021bii angaja\u021bi cu norm\u0103 \u00eentreag\u0103 durata normal\u0103 a timpului de munc\u0103 este de 8 ore pe zi \u0219i de 40 de ore pe s\u0103pt\u0103m\u00e2n\u0103\u201d, <\/p><\/blockquote>\n\n\n\n<p>prevede Codul muncii, iar, mai departe, prevede c\u0103 <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201eSalariatul cu frac\u021biune de norm\u0103 este salariatul al c\u0103rui num\u0103r de ore normale de lucru, calculate s\u0103pt\u0103m\u00e2nal sau ca medie lunar\u0103, este inferior num\u0103rului de ore normale de lucru al unui salariat cu norm\u0103 \u00eentreag\u0103 comparabil\u201d. <\/p><\/blockquote>\n\n\n\n<p>Cu alte cuvinte: ambii au dreptul la zile libere, concedii medicale \u0219.a.m.d.<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>2<\/strong>.<\/span> <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Care e diferen\u021ba dintre un contract pe perioad\u0103 determinat\u0103 \u0219i unul pe perioad\u0103 nedeterminat\u0103?<\/span><\/strong><\/p>\n\n\n\n<p>Regula o constituie, f\u0103r\u0103 dar \u0219i poate, contractele pe perioad\u0103 nedeterminat\u0103, adic\u0103 acolo unde finalul raportului de munc\u0103 nu este unul cert, stabilit dinainte. Dar \u00een practic\u0103 se \u00eencheie adesea contracte pe c\u00e2teva luni, pe un an sau doi. Contractul pe durat\u0103 determinat\u0103 nu poate fi \u00eencheiat pe o perioad\u0103 mai mare de 36 de luni pentru c\u0103 nu permite legea.<\/p>\n\n\n\n<p><strong><span style=\"color:#f05a23\" class=\"has-inline-color\">3.<\/span><\/strong> <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Po\u021bi avea mai multe contracte de munc\u0103 \u00een acela\u0219i timp?<\/span><\/strong><\/p>\n\n\n\n<p>Da, legea nu restric\u021bioneaz\u0103 \u00een acest sens.&nbsp;<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>4<\/strong><\/span>. <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Trebuie s\u0103 prime\u0219ti o copie a contractului de munc\u0103?<\/span><\/strong><\/p>\n\n\n\n<p>Nu o copie, ci un exemplar. \u00cen Codul muncii scrie c\u0103 angajatorul este obligat ca, anterior \u00eenceperii activit\u0103\u021bii, s\u0103 \u00eenm\u00e2neze salariatului un exemplar din contractul individual de munc\u0103.<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>5<\/strong><\/span>. <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Ce \u00eenseamn\u0103 perioada de prob\u0103?<\/span><\/strong><\/p>\n\n\n\n<p>Este perioad\u0103 de prob\u0103 dac\u0103 nu exist\u0103 un contract de munc\u0103 \u00een derulare \u00een acea perioad\u0103. Chiar dac\u0103 are o lun\u0103, dou\u0103, 15 zile sau 90, perioada de prob\u0103 se face \u00een baza unui contract de munc\u0103 &#8211; ce fie continu\u0103, fie \u00eenceteaz\u0103 la momentul c\u00e2nd se termin\u0103 respectiva perioad\u0103. Dac\u0103 nu ai contract de munc\u0103 \u00een acea perioad\u0103 se cheam\u0103 c\u0103 munce\u0219ti la negru, adic\u0103 f\u0103r\u0103 acte, iar drepturile tale ca salariat nu exist\u0103, din moment ce nu e\u0219ti \u00eencadrat ca unul. Cel mai mare dezavantaj \u0219i pe care \u00eel vei resim\u021bi imediat e acela c\u0103 s-ar putea s\u0103 nu prime\u0219ti salariu sau s\u0103 prime\u0219ti mai pu\u021bin dec\u00e2t \u021bi s-a spus.<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>6<\/strong><\/span>. <strong><span style=\"color:#f05a23\" class=\"has-inline-color\">Ai dreptul s\u0103 fii pl\u0103tit cel pu\u021bin cu salariul minim &#8211; dar ce \u00eenseamn\u0103 asta?<\/span><\/strong><\/p>\n\n\n\n<p>Valoarea salariului minim e stabilit\u0103 la nivelul unui act normativ \u0219i, \u00een cazul Rom\u00e2niei, s-a tot schimbat de la an la  an, \u00een sensul c\u0103 valoarea a tot crescut, pu\u021bin c\u00e2te pu\u021bin (\u00een 2021 este de 2.300 de lei, adic\u0103 13,583 lei\/or\u0103 la un program normal de lucru, full-time &#8211; dar aceasta e valoarea sa brut\u0103, adic\u0103 f\u0103r\u0103 s\u0103 i se aplice impozitele \u0219i taxele pe care trebuie s\u0103 le dai statului). Desigur, \u00een cazul celor ce lucreaz\u0103 part-time, salariul minim se va diminua \u0219i el corespunz\u0103tor.<\/p>\n\n\n\n<p><br>Fire\u0219te, \u00een afara salariului, prin contract se poate decide acordarea \u0219i altor beneficii &#8211; extrasalariale. Cuantumul acestora nu se include \u00eens\u0103 \u00een valoarea aceasta minim\u0103 a salariului, cerut\u0103 de lege.<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>7. Ce taxe \u0219i impozite pl\u0103te\u0219ti, de principiu, la salariul din contract?<\/strong><\/span><\/p>\n\n\n\n<p>Spunem \u201ede principiu\u201d pentru c\u0103 plec\u0103m de la ideea c\u0103 nu faci parte dintr-o categorie care beneficiaz\u0103 de vreo scutire de impozit (cum e scutirea de impozit din domeniul IT, de pild\u0103). Pentru salarii se pl\u0103te\u0219te impozitul pe venit de 10%, contribu\u021bia la pensii de 25% (asigur\u0103ri sociale) \u0219i contribu\u021bia la s\u0103n\u0103tate de 10% (asigur\u0103ri sociale de s\u0103n\u0103tate).<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>8. Zilele libere \u0219i concediile &#8211; care sunt drepturile minime de care trebuie s\u0103 beneficiezi?<\/strong><\/span><\/p>\n\n\n\n<p>Codul muncii este actul normativ ce stabile\u0219te zilele libere ale salaria\u021bilor din \u021bara noastr\u0103 &#8211; vorbim de liberele legale, zile pl\u0103tite, \u00een care angaja\u021bii nu ar trebui s\u0103 se duc\u0103 la munc\u0103. Sunt \u00eens\u0103 domenii\/industrii unde activitatea nu poate fi pus\u0103 complet pe pauz\u0103, a\u0219a c\u0103 cei care sunt nevoi\u021bi s\u0103 lucreze \u00een aceste zile libere prev\u0103zute de lege. Dac\u0103 salaria\u021bii lucreaz\u0103 \u00een zile de s\u0103rb\u0103toare legal\u0103, angajatorii sunt obliga\u021bi s\u0103 le acorde acestora compensa\u021bii. Adic\u0103, pentru lucrul \u00een zilele libere, salaria\u021bii au dreptul la compensarea cu timp liber corespunz\u0103tor \u00een urm\u0103toarele 30 de zile. Dac\u0103 nu se poate acorda liber, salaria\u021bii au dreptul la un spor salarial de cel pu\u021bin 100% din salariul de baz\u0103 (<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/avocatnet.ro\/articol_56676\/Zile-libere-2021-Mai-mult-de-jum%C4%83tate-dintre-liberele-de-anul-acesta-pic%C4%83-in-weekend.html\" data-type=\"URL\" data-id=\"https:\/\/avocatnet.ro\/articol_56676\/Zile-libere-2021-Mai-mult-de-jum%C4%83tate-dintre-liberele-de-anul-acesta-pic%C4%83-in-weekend.html\" target=\"_blank\">\u00een 2021, multe dintre liberele legale au picat \u00een zile de weekend<\/a>,<\/strong> astfel c\u0103 salaria\u021bii nu s-au putut bucura deloc de ele, cu excep\u021bia celor care lucreaz\u0103 \u00een weekend-uri).<\/p>\n\n\n\n<p><br>\u00cen ceea ce prive\u0219te concediul de odihn\u0103, angajatorul are obliga\u0163ia de a acorda concediu \u00een fiecare an. Codul muncii prevede c\u0103 fiecare salariat poate primi minimum 20 de zile lucr\u0103toare de concediu de odihn\u0103 pe an. Desigur, se pot negocia \u0219i mai multe, dar nu mai pu\u021bine de at\u00e2t, iar asta indiferent dac\u0103 vorbim de contracte full-time sau nu. Concediul de odihn\u0103 \u00eenseamn\u0103 zile libere pl\u0103tite!<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>9. Munca suplimentar\u0103 cum se recompenseaz\u0103?<\/strong><\/span><\/p>\n\n\n\n<p>\u00cen primul r\u00e2nd, munca suplimentar\u0103 se face \u00een anumite limite trasate de lege: o dat\u0103, nu poate s\u0103 fie excesiv\u0103, \u00eentruc\u00e2t ar \u00eensemna c\u0103 norma de munc\u0103 normal\u0103 este, \u00een realiate, mai mare dec\u00e2t cea din contract, deci se munce\u0219te pe jum\u0103tate \u201ela negru\u201d, iar din alt\u0103 perspectiv\u0103, devine o problem\u0103 faptul c\u0103 angajatul nu mai are parte de repausul la care are dreptul conform legii. Codul muncii stabile\u0219te c\u0103 durata maxim\u0103 legal\u0103 a timpului de munc\u0103 nu poate dep\u0103\u0219i 48 de ore pe s\u0103pt\u0103m\u00e2n\u0103, inclusiv ore suplimentare, ceea ce \u00eenseamn\u0103 c\u0103, pe l\u00e2ng\u0103 cele 40 de ore de munc\u0103, angajatul poate presta suplimentar doar 8 ore \u00een decursul unei s\u0103pt\u0103m\u00e2ni sau, mai exact, 96 de minute \u00een fiecare zi.<\/p>\n\n\n\n<p><br>Recompensarea muncii suplimentare printr-un spor la salariu este excep\u021bia de la regul\u0103 \u00eens\u0103 &#8211; angaja\u021bilor ar trebui s\u0103 li se dea timp liber pl\u0103tit corespunz\u0103tor orelor respective, lucrate peste program.<\/p>\n\n\n\n<p><br><strong>Aten\u021bie!<\/strong> Refuzul de a efectua munc\u0103 suplimentar\u0103 nu constituie abatere disciplinar\u0103, iar salariatul nu poate fi dat afar\u0103 dac\u0103 nu vrea s\u0103 stea peste program.<\/p>\n\n\n\n<p><span style=\"color:#f05a23\" class=\"has-inline-color\"><strong>10. Unde te ui\u021bi ca s\u0103 vezi care sunt drepturile tale ca salariat?<\/strong><\/span><\/p>\n\n\n\n<p>Ca salariat, \u021bi se aplic\u0103 \u00een primul r\u00e2nd <strong><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/41627\" data-type=\"URL\" data-id=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/41627\" target=\"_blank\" rel=\"noreferrer noopener\">Codul muncii<\/a>.<\/strong> Dac\u0103 e\u0219ti telesalariat, adic\u0103 ai un contract de telemunc\u0103 sau cu clauz\u0103 de telemunc\u0103, atunci te ui\u021bi mai \u00eent\u00e2i \u00een Legea nr. 81\/2018, dar care oricum se completeaz\u0103 cu Codul muncii.<\/p>\n\n\n\n<p><br>Apoi, te intereseaz\u0103 con\u021binutul contractului t\u0103u de munc\u0103, unde sunt prev\u0103zute drepturile \u0219i obliga\u021biile p\u0103r\u021bilor, precum \u0219i regulamentul intern din firma \u00een care te angajezi, care ar trebui s\u0103-\u021bi fie adus la cuno\u0219tin\u021b\u0103 c\u00e2t mai cur\u00e2nd.
