Contractele de munc\u0103 \u00eencheiate f\u0103r\u0103 certficat medical sunt nule"},"content":{"rendered":"\n<p class=\"has-drop-cap\">Contractele individuale de munc\u0103 \u00eencheiate \u00een lipsa unui certificat medical care s\u0103 constate faptul c\u0103 viitorul angajat este apt de munc\u0103 sunt nule, conform Codului muncii. \u00cen plus, angajatorii care ignor\u0103 aceste obliga\u021bii risc\u0103 amenzi de p\u00e2n\u0103 la 3.000 de lei.<\/p>\n\n\n\n<p><strong>Un contract de munc\u0103 este valabil \u00eencheiat numai \u00een baza unui certificat medical care s\u0103 ateste c\u0103 noul salariat e apt s\u0103 presteze munc\u0103 la acel angajator<\/strong> (nu apt de munc\u0103, la modul general, \u00eentruc\u00e2t formularea din Codul muncii este &#8220;<em>apt pentru prestarea acelei munci&#8221;<\/em>).<\/p>\n\n\n\n<p>Este \u00eens\u0103 obliga\u021bia angajatorului s\u0103 se preocupe de tot ceea ce \u021bine de medicina muncii pentru salaria\u021bii s\u0103i. <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;Angajatorii au obliga\u021bia s\u0103 asigure accesul salaria\u021bilor la serviciul medical de medicin\u0103 a muncii&#8221; <\/p><cite>prevede Codul muncii.<\/cite><\/blockquote>\n\n\n\n<p>Mai exact, nu salariatul trebuie s\u0103 scoat\u0103 bani din buzunar pentru chestiunile ce \u021bin de medicina muncii. Ideea e \u00eent\u0103rit\u0103 \u0219i de legisla\u021bia special\u0103 de s\u0103n\u0103tate \u0219i securitate \u00een munc\u0103, unde principiul e c\u0103 aceste cerin\u021be nu trebuie s\u0103 genereze obliga\u021bii financiare pentru salariat.<\/p>\n\n\n\n<p>S\u0103 lu\u0103m \u00eens\u0103 obliga\u021bia de a avea dovada c\u0103 salariatul X e apt de munca ce urmeaz\u0103 a fi prestat\u0103 potrivit contractului drept primul pas \u00een \u00eendeplinirea, de c\u0103tre angajator, a obliga\u021biei de a supraveghea starea de s\u0103n\u0103tate a angaja\u021bilor s\u0103i. <em>Hot\u0103r\u00e2rea Guvernului nr. 355\/2007 privind supravegherea s\u0103n\u0103t\u0103\u021bii lucr\u0103torilor<\/em> stabile\u0219te \u00een sarcina angajatorului <strong>obliga\u021bia de a asigura fondurile necesare efectu\u0103rii tuturor serviciilor medicale profilactice necesare pentru supravegherea s\u0103n\u0103t\u0103\u021bii salaria\u021bilor.<\/strong><\/p>\n\n\n\n<p>Ce \u00een\u021belegem prin<strong> servicii medicale profilactice<\/strong>, potrivit aceleia\u0219i hot\u0103r\u00e2ri: examenul medical la angajarea \u00een munc\u0103, de adaptare, periodic, la reluarea activit\u0103\u021bii, supraveghere special\u0103 \u0219i promovarea s\u0103n\u0103t\u0103\u021bii la locul de munc\u0103. Practic, este destul de clar c\u0103 toate costurile, inclusiv pentru examenul medical de la angajare, sunt obligatoriu suportate de angajator.<\/p>\n\n\n\n<p><br>Examenul medical la angajare se face at\u00e2t la \u00eencheierea contractului de munc\u0103 pe perioad\u0103 determinat\u0103\/nedeterminat\u0103, potrivit hot\u0103r\u00e2rii, c\u00e2t \u0219i atunci c\u00e2nd se face o deta\u0219are. Se face \u0219i la schimbarea meseriei sau profesiei<\/p>\n\n\n\n<p><br>\u00cen mod ideal, \u00een func\u021bie de rezultatul examenului medical la angajare, medicul de medicina muncii poate s\u0103 fac\u0103 unele propuneri pentru eventuala adaptare a postului la caracteristicile anatomice, fiziologice, psihologice \u0219i la starea de s\u0103n\u0103tate a lucr\u0103torilor. De pild\u0103, o persoan\u0103 cu probleme la coloan\u0103 ar putea avea nevoie de un scaun special.<\/p>\n\n\n\n<p>Ce <strong>nu poate solicita nicio firm\u0103 la angajare<\/strong> este testul de graviditate, chestiune interzis\u0103 prin Codul muncii.<\/p>\n\n\n\n<p><br>Potrivit <em>Legii nr. 319\/2006 a securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103<\/em>, firmele sunt obligate s\u0103 angajeze numai persoane care, \u00een urma examenului medical \u0219i, dup\u0103 caz, a test\u0103rii psihologice a aptitudinilor, corespund sarcinii de munc\u0103 pe care urmeaz\u0103 s\u0103 o execute \u0219i s\u0103 asigure controlul medical periodic \u0219i, dup\u0103 caz, controlul psihologic periodic, ulterior angaj\u0103rii.
