Dac\u0103, \u00eens\u0103, angajatorul decide c\u0103 activitatea companiei nu poate fi \u00eentrerupt\u0103, pe anumite considerente obiective, salaria\u021bii prezen\u021bi la munc\u0103 \u00eentr-una dintre cele 15 zile de s\u0103rb\u0103toare legal\u0103 din an trebuie s\u0103 primeasc\u0103 fie o zi liber\u0103 pentru fiecare zi muncit\u0103, fie un spor la salariu de minim 100% aplicat zilei muncite.  <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Important!&nbsp;<\/strong>Regula general\u0103 este c\u0103&nbsp;<strong>\u00een zilele de s\u0103rb\u0103toare legal\u0103 nu se lucreaz\u0103<\/strong>. Aceste zile sunt prev\u0103zute de Codul muncii, iar angajatorul are obliga\u021bia de a le acorda, nefiind necesar\u0103 o solicitare a salaria\u021bilor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Codul muncii nu distinge \u00eentre salaria\u021bii pl\u0103ti\u021bi din fonduri publice (bugetari) \u0219i cei din economia privat\u0103, deci regula este general\u0103: \u00een zilele de s\u0103rb\u0103toare legal\u0103 nu se lucreaz\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Legiuitorul a prev\u0103zut \u0219i situa\u021biile \u00een care&nbsp;<strong>activitatea nu poate fi \u00eentrerupt\u0103<\/strong>&nbsp;datorit\u0103 caracterului procesului de produc\u021bie sau specificului activit\u0103\u021bii, \u00eens\u0103 angajatorul este obligat s\u0103 acorde, \u00een principal, timp liber corespunz\u0103tor \u00een urm\u0103toarele 30 de zile.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ce se \u00eent\u00e2mpl\u0103 \u00een cazul \u00een care salaria\u021bii lucreaz\u0103 \u00eentr-o zi declarat\u0103 s\u0103rb\u0103toare legal\u0103?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen primul r\u00e2nd, angajatorul va lua aceast\u0103 decizie atunci c\u00e2nd se \u00eencadreaz\u0103 \u00een limitele excep\u021biilor prev\u0103zute de Codul muncii, adic\u0103 poate justifica fie c\u0103 situa\u021bia \u00een care procesul de produc\u021bie nu poate fi \u00eentrerupt, fie c\u0103 specificul activit\u0103\u021bii nu permite acordarea zilei libere sau este afectat semnificativ.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen al doilea r\u00e2nd,<strong>&nbsp;angajatorul este obligat s\u0103 compenseze<\/strong>&nbsp;ziua respectiv\u0103&nbsp;<strong>prin acordarea de timp liber<\/strong>&nbsp;corespunz\u0103tor,&nbsp;<strong>\u00een cel mult 30 de zile<\/strong>, fiind vorba despre zile calendaristice, nu lucr\u0103toare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Presupun\u00e2nd c\u0103 nici \u00een interiorul acestui termen nu poate fi compensat\u0103 ziua de s\u0103rb\u0103toare lucrat\u0103, atunci&nbsp;<strong>angajatorul are obliga\u021bia de a acorda un spor la salariu de cel pu\u021bin 100%<\/strong>, corespunz\u0103tor timpului de munc\u0103 necompensat.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0218i \u00een acest caz angajatorul ar trebui s\u0103 fie \u00een m\u0103sur\u0103 s\u0103 probeze imposibilitatea compens\u0103rii prin acordarea de timp liber \u00een termenul de 30 de zile, principiul fiind similar cu cel care a determinat impunerea activit\u0103\u021bii \u00een ziua de s\u0103rb\u0103toare legal\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Observ\u0103m c\u0103, \u0219i \u00een aceast\u0103 situa\u021bie, legiuitorul a stabilit c\u0103 timpul liber este pe primul loc, regula fiind acordarea sa, sporul fiind excep\u021bia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>C\u00e2nd trebuie s\u0103 probeze\/justifice angajatorul imposibilitatea acord\u0103rii zilei\/zilelor libere, fie \u00een ziua\/zilele de s\u0103rb\u0103toare legal\u0103, fie \u00een urm\u0103toarele 30 de zile?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dac\u0103 ne raport\u0103m exclusiv la dreptul angajatorului de a stabili organizarea \u0219i func\u021bionarea unit\u0103\u021bii, am putea crede c\u0103 nu exist\u0103 o astfel de obliga\u021bie, \u00eens\u0103 trebuie s\u0103 \u021binem cont \u0219i de principiul consensualit\u0103\u021bii \u0219i al bunei-credin\u021be.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">De asemenea, \u00een cazul unui control, angajatorului i se poate solicita s\u0103 justifice, poate chiar \u0219i s\u0103 probeze, decizia de a men\u021bine activitatea \u00eentr-o zi declarat\u0103 ca fiind s\u0103rb\u0103toare legal\u0103 \u00een care nu se lucreaz\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Atunci c\u00e2nd exist\u0103 un conflict de munc\u0103 \u0219i el ajunge \u00een fa\u021ba instan\u021bei competente, angajatorul poate fi chiar obligat s\u0103 probeze imposibilitatea de a acorda liber salaria\u021bilor \u00eentr-o zi de s\u0103rb\u0103toare legal\u0103 sau \u00een termenul prev\u0103zut de Codul muncii, dup\u0103 caz.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen acela\u0219i timp, salaria\u021bii care consider\u0103 c\u0103, \u00een mod nejustificat, angajatorul nu le-a acordat zilele libere prev\u0103zute de Codul muncii sau, tot nejustificat, nu le-au fost compensate prin acordarea de timp liber corespunz\u0103tor \u00een cel mult 30 de zile, pot sesiza Inspec\u021bia Muncii sau chiar instan\u021ba competent\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aceea\u0219i solu\u021bie o au \u0219i \u00een cazul \u00een care, de\u0219i nu le-a fost compensat\u0103 ziua de s\u0103rb\u0103toare legal\u0103 lucrat\u0103 \u00een cel mult 30 de zile prin acordarea de timp liber, nu le-a fost acordat nici sporul la salariu prev\u0103zut ori acesta nu a fost de cel pu\u021bin 100%.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen privin\u021ba sporului, legiuitorul a prev\u0103zut <strong>procentul minim de 100%<\/strong>, \u00eens\u0103 acesta face obiectul negocierii, individuale sau colective, nefiind prev\u0103zut\u0103 o limit\u0103
