Oric\u00e2t de tentante ar fi oferta de munc\u0103 \u0219i beneficiile, lucrurile nu se vor petrece \u00eentotdeauna \u00een modul ideal \u00een care ne-am imaginat, iar postul respectiv s-ar putea dovedi, \u00een c\u00e2teva luni, ceva mult diferit de a\u0219tept\u0103rile ini\u021biale.\u00a0<\/p>\n\n\n\n<p>Un exemplu de clauz\u0103 des \u00eent\u00e2lnit\u0103 \u00een contracte \u0219i care este facultativ\u0103, nu obligatorie, este cea de neconcuren\u021b\u0103: \u201e<em><strong>La \u00eencheierea contractului individual de munc\u0103 sau pe parcursul execut\u0103rii acestuia<\/strong>, p\u0103r\u021bile pot negocia \u0219i cuprinde \u00een contract o clauz\u0103 de neconcuren\u021b\u0103 prin care&nbsp;<strong>salariatul s\u0103 fie obligat ca dup\u0103 \u00eencetarea contractului s\u0103 nu presteze, \u00een interes propriu sau al unui ter\u021b, o activitate care se afl\u0103 \u00een concuren\u021b\u0103 cu cea prestat\u0103 la angajatorul s\u0103u,<\/strong>&nbsp;\u00een schimbul unei indemniza\u021bii de neconcuren\u021b\u0103 lunare pe care angajatorul se oblig\u0103 s\u0103 o pl\u0103teasc\u0103 pe toat\u0103 perioada de neconcuren\u021b\u0103<\/em>\u201d, scrie \u00een Codul muncii, la art. 21 (\u0219i urm\u0103toarele), unde sunt prev\u0103zute toate aspectele legale privind acest tip de clauz\u0103 ce poate fi \u00eent\u00e2lnit\u0103 \u00een contractele de munc\u0103 &#8211; condi\u021bii \u00een care e legal\u0103, perioada maxim\u0103 de acordare, indemniza\u021bia aferent\u0103 \u0219.a.m.d.<\/p>\n\n\n\n<p>Astfel de clauze sunt incluse uneori \u00een contracte \u00eenc\u0103 de la \u00eenceputul raportului de munc\u0103 &#8211; adic\u0103 \u00eenc\u0103 din perioada de prob\u0103. Angajatorii nu fac nicio diferen\u021b\u0103 \u00eentre acele luni de prob\u0103 \u0219i restul raportului de munc\u0103 atunci c\u00e2nd vine vorba de impunerea lor, de\u0219i<strong> poate fi considerat\u0103 o restr\u00e2ngere nerezonabil\u0103 a dreptului la munc\u0103.<\/strong><\/p>\n\n\n\n<p>Perioada de prob\u0103 serve\u0219te p\u0103r\u021bilor tocmai s\u0103 vad\u0103 dac\u0103 rela\u021bia de munc\u0103 ar putea s\u0103 fie a\u0219a cum ambele \u0219i-au prefigurat-o, e perioada \u00een care angajatul \u00ee\u0219i d\u0103 seama dac\u0103 se potrive\u0219te a\u0219tept\u0103rilor firmei, dac\u0103 e pl\u0103tit suficient pentru munca depus\u0103, dac\u0103 se integreaz\u0103 cu colectivul, dac\u0103 poate avea o rela\u021bie bun\u0103 cu superiorul s\u0103u \u0219.a.m.d.. Ce poate face un angajat care, dup\u0103 dou\u0103 luni, av\u00e2nd o atare clauz\u0103 \u201edeasupra capului\u201d, decide c\u0103 nu mai dore\u0219te s\u0103 continue munca \u00een acel loc \u0219i-i trimite angajatorului o notificare pentru \u00eencetarea contractului?
